Shark Stop – Terms & Conditions of Sale

These Terms & Conditions (“Terms”) govern your access to and use of the Shark Stop website, www.Shark Stop.co (“Site”), and your purchase of any products (“Products”) from Shark Stop Pty Ltd ABN 17 649 234 757 (“we”, “us”, “our”, or “Shark Stop”). By placing an order on this Site, you agree to be bound by these Terms, our Privacy Policy, and any other policies referenced herein.

If you do not accept these Terms, you must not use this Site or purchase any Products.

 

1. WARNING & SAFETY INFORMATION

Watersports and ocean activities carry inherent risks, particularly when sharks are present. By purchasing or wearing a Shark Stop wetsuit, you acknowledge the following:

  • No Guarantee of Safety: Shark Stop wetsuits are not a life-saving device. While our products are designed to reduce the extent of skin penetration from shark bites, they will not prevent a shark bite, reduce the likelihood of a shark encounter, or prevent death, injury, or drowning resulting from shark activity.

  • Limited Protection: Shark Stop wetsuits are constructed using patented materials intended to reduce soft tissue injury caused by shark bites. They do not offer protection from:

    • The force or pressure of a shark bite (including crushing, bruising, or bone injury);

    • Drowning or other water-related hazards;

    • Any injuries not caused directly by a shark bite, including accidents, marine conditions, or human error.

  • Use at Your Own Risk: Use of the Products is entirely at your own risk. You are solely responsible for your conduct and safety in the water.

  • No Liability: To the maximum extent permitted by law, Shark Stop Pty Ltd disclaims all liability for any personal injury, death, or damage arising from the use or misuse of our Products.

 

2. RESPONSIBLE USE & BEHAVIOUR

2.1. Prohibited Conduct

Shark Stop advocates for respectful and ethical engagement with marine life. While wearing a Shark Stop wetsuit, you must not:

  • Touch, harass, ride, provoke, or interfere with sharks or any marine life;

  • Engage in conduct that could be classified as a “provoked attack” under the International Shark Attack File;

  • Use the wetsuit in a way that creates risk for yourself or others.

2.2. Promoting Marine Stewardship

Shark Stop supports marine conservation. Users are encouraged to:

  • Respect marine ecosystems;

  • Observe marine life from a safe and non-intrusive distance;

  • Share accurate and respectful information about your experience with others;

  • Avoid promoting unsafe or provocative behaviour in social media or other forums.

 

3. PRODUCT PERFORMANCE & MATERIAL DISCLAIMER

Shark Stop wetsuits are constructed using a unique combination of our proprietary Shark Stop® protective fabric and Yamamoto 39 neoprene, providing comfort and enhanced protection. Due to this combination:

  • Seam Stress Zones: Seams where these materials meet (e.g. underarms) are subject to high stress and minor tearing or splitting is a known and expected cosmetic outcome during early wear.

  • These cosmetic tears do not affect the protective performance of the wetsuit.

  • Returns due to such wear will not be accepted. Please do not purchase the Product if you do not accept this condition.

 

4. ORDERS, PAYMENT & PRICING

4.1. Orders

  • All orders are subject to acceptance and availability.

  • We reserve the right to refuse or cancel an order at any time due to product availability, pricing error, or suspected fraud.

4.2. Pricing

  • All prices are listed in AUD and include GST (where applicable).

  • We reserve the right to adjust prices at any time without prior notice.

4.3. Payment

  • We accept payments via major credit cards and payment platforms as displayed at checkout.

  • Payment must be made in full before your order is dispatched.

 

5. SHIPPING & DELIVERY

  • We ship worldwide using third-party courier services.

  • Delivery timeframes are estimates only and not guaranteed.

  • We are not responsible for delays due to customs clearance, weather, or carrier issues.

 

6. RETURNS & EXCHANGES

6.1. No Returns for Change of Mind

We do not offer refunds for change of mind or incorrect sizing. This is due to the environmental impact of excess shipping and returns, and our commitment to responsible consumer practices.

6.2. Exchanges

We offer exchanges within 30 days of purchase for unworn, unwashed, and undamaged items, subject to the following:

  • Exchange requests must be submitted via our contact form or email;

  • Items must be returned in original packaging;

  • Return shipping costs are the buyer’s responsibility;

  • We may refuse exchanges for items showing signs of wear or damage.

Please Note: Shark Stop wetsuits have less stretch due to the protective fabric. Carefully consult our sizing guide prior to purchase.

 

7. INTELLECTUAL PROPERTY

All intellectual property including but not limited to the Shark Stop® name, logos, product designs, website content, photos, videos, and trademarks are owned or licensed by Shark Stop Pty Ltd. You may not reproduce, distribute, modify or use any part of our IP without prior written consent.

 

8. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

  • Shark Stop Pty Ltd shall not be liable for any indirect, incidental, special or consequential damages, including loss of profits, personal injury, or death.

  • Our total liability shall not exceed the amount you paid for the Product giving rise to the claim.

 

9. WARRANTY

Shark Stop wetsuits are covered by a 12-month warranty against manufacturing defects in materials and workmanship. This does not cover:

  • Damage caused by misuse, accidents, or normal wear and tear;

  • Cosmetic damage such as seam fraying, pilling, or tears in high-stress areas as disclosed above;

  • Improper storage, washing, or use contrary to care instructions.

To initiate a warranty claim, contact us at orders@sharkstop.co. Proof of purchase and photos of the issue will be required.

 

10. PRIVACY

We respect your privacy and handle your personal information in accordance with our Privacy Policy, available on our website.

 

11. GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.

 

12. UPDATES TO THESE TERMS

We reserve the right to amend these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site constitutes acceptance of the revised Terms.
